Unbeknownst to many people, including those with a history of substance use disorders, the ADA includes substance use disorder as a disability, extending the law’s protections to people in recovery or with a history of substance use. This means that refusing to provide somebody with medications for opioid addiction or refusing to provide services to somebody currently taking medication for opioid addiction is, and has been, illegal. Increasingly, the Justice Department is enforcing these protections and securing care delivery for people who’ve been denied services because of a substance-use-related factor.
